Abstract

The study discusses the extent to which the imam may be excommunicated in Islamic jurisprudence and the Yemeni Penal Code.

The aim of this study is to highlight the legal rulings of the Qur'aan and Sunnah and the words of scholars and the aim of protecting societies and securing them from the prostitute and its causes and rooting out its causes.

This research included four topics preceded by a preliminary demand, the first section was devoted to talk about the conditions of exit on the Imam unjust. The second topic was devoted to addressing the sayings of scholars in the coming out on the unjust Imam. The third topic was devoted to talk about the legality of the exit to the unjust Imam. In the fourth topic, the position of the Code of Crimes and Penalties was addressed.

The most important of these results was the agreement of the Yemeni Penal Code with the doctrine of the majority of scholars that it is not permissible to go out against the unjust imam even if he is unjust.
