Abstract

Defenses by referral to engagement are a type of formal defense
in most legislation, and they must be taken into account because of
their great importance, and the implications they have for unifying
procedures for considering multiple cases related to cause, subject
and parties, and in easing the burden on the judiciary.
This study aimed to know the concept of payment by referral of
the link, the legal assumptions for payment by referral of the link,
and to know the problems and obstacles that prevent the application
of the legal system for payment by referral of the link.
This research includes two sections: The first section is devoted
to clarify the idea and assumptions of payment by referral for the
link. The second section was devoted to show the effects and
problems of payment by referral for engagement.
The descriptive, analytical and inductive approach was used to
define the concept of payment by referral for the link through the
available legal references, and to analyze the reality and legal texts
in the Civil Procedures Law and its amendments by Law No. 1 of
2021 AD, and compared them with the Egyptian law and laws
related to the subject of the research. A number of results and
recommendations were achieved as mentioned in the conclusion.
